Terms & Conditions – Betontools Australia

1. General

Displayed products and prices on this site are an invitation to treat only.
No contract exists until we accept your order. We may accept or reject any order at our discretion.
Acceptance of an order is subject to these terms and conditions only.
We may change or withdraw any product at any time before your order is accepted.

Product Information

Products and prices are subject to change and availability.
We make every effort to reflect products accurately, but images and descriptions may vary.

2. Validity

Unless stated otherwise, quotations are valid for 30 days.
Quotations may be changed or withdrawn prior to acceptance.

3. Scope

Quotations cover only goods and services specified therein.
Goods offered ex-stock are subject to prior sale.
Delivery times are approximate and should be confirmed at the time of order.

4. Information and Drawings

Specifications, illustrations, drawings, data, dimensions, and weights are typical and may change without notice.
These do not form part of a quotation unless specified in writing.

5. Packing

Products are delivered using our standard packing.
Any variation will incur additional charges.

6. Prices

Pricing Information

Dangerous Goods Surcharge (DGS) is $18.00. Dangerous goods cannot be sent by air; international orders are not accepted for these items.
Prices and product availability may vary.
Prices are current at the last update but may change without notice (E. & O.E.).
We reserve the right to correct website errors.
Most customers are businesses (B2B), but sales to individual consumers are also available.
Payment via credit cards or TT is accepted.

Conditions of sale apply to all catalogue items and cannot be varied or cancelled unless agreed in writing.
Prices are those at dispatch unless otherwise agreed.
Price quotes for quantity purchases may be renegotiated if quantities change.

7. GST & Government Imposts

Most customers are businesses (B2B), but sales to individual consumers are also available.

Prices Exclude GST and GST of 10% is Calculated at Checkout.
Customers are responsible for paying any applicable GST or government charges.

8. Terms of Payment

For credit account holders, invoices are payable 30 days from the invoice date unless stated otherwise.
Payments are due without set-off, counterclaim, or deduction except as required by law.
Credit extensions may be refused. We use Veda Advantage for credit reporting.

9. Recovery of Collection Costs

Late payments incur interest at the Reserve Bank cash rate + 4%.
Customers are responsible for all debt collection costs.

10. Liability of Betontools Australia

We are not liable for indirect or consequential loss (including loss of profit or contracts), except as expressly provided.
For goods not ordinarily acquired for personal/domestic use, our liability for consumer guarantees is limited to repair, replacement, supply of equivalent goods, or associated costs.

11. Governing Law and Jurisdiction

Contracts are governed by the laws of New South Wales, Australia.
Parties submit to the exclusive jurisdiction of NSW courts.

12. Variation

Any order variations must be approved in writing.
You indemnify us against any resulting loss or damage.

13. Retention of Title

Goods remain our property until all debts are paid.
You may sell goods in the ordinary course of business as our agent.
Goods are at your risk during transit.
We may reclaim goods if:
1. Payment is overdue
2. You breach any contract
3. You enter external administration or bankruptcy
4. Goods are transferred other than in ordinary course of business

14. Product Returns

Returns require a Betontools Return Authorisation.
Items must be in resalable condition.
Returns without authorisation or not in resalable condition will be returned.
A 20% rebooking fee applies for returns not due to our error.
Special-order items from suppliers cannot be returned.

15. Delivery

Domestic orders are shipped via courier for best price.
Larger, heavy, or bulk orders will be quoted delivery costs before shipment.
Standard shipping fee: $15+GST. If fees exceed this, we will contact you.

16. Repair Services and Lien

Quotation fee: $15 + GST to disassemble and prepare a repair quote.
Fee is waived if the quote is accepted.
Betontools has a lien on all repair items until charges are paid.
Uncollected items may be sold to recover costs.

17. Warranty Claims

Conditions for Warranty

Product is of merchantable quality and used in a suitable environment.
Original invoice or proof of purchase provided.
Customer covers return shipping, transport, and insurance costs.
Product has not been misused, altered, or serviced by unauthorized persons.

Legal Rights

This warranty is in addition to rights under Australian Consumer Law.
Customers may receive replacement, refund, or repair for major failures.

Exclusions

Misuse, abuse, or operation outside instructions
Incorrect batteries or unauthorized parts
Tampering or mechanical adjustments inconsistent with the manual
Storage or maintenance inconsistent with instructions
Products purchased from unauthorized sellers
Accidental damage, natural wear, environmental factors, or force majeure
Freight costs for warranty transport
Consumables (batteries, etc.)
No changes to warranty conditions without written approval.
